These Terms and Conditions ("Terms") govern your use of kubbi.co.uk and your purchase of any Kubbi product. By placing an order, creating an account, or using our website, you agree to these Terms. Please read them carefully.

These Terms apply alongside our other policies, which form part of your contract with us:

Nothing in these Terms limits or replaces your statutory rights as a UK consumer under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, or any other applicable consumer protection law.

References in these Terms to "Kubbi", "we", "us", and "our" mean Kubbi Imports Ltd. References to "you" and "your" mean the customer or person using our website.

Placing an Order

When you place an order on kubbi.co.uk, you are making an offer to buy the products listed at the prices shown. Your order is not accepted by us until we confirm dispatch by email. A binding contract is formed at the point of dispatch confirmation.

We reserve the right to refuse any order, including (but not limited to) cases where:

  • The product is out of stock or no longer available
  • There has been a pricing or product description error on our website
  • We are unable to verify the payment or delivery details you provided
  • We suspect fraud or misuse

If we cannot accept your order, we will notify you by email and refund any payment taken.

Pricing and Payment

All prices on kubbi.co.uk are shown in pounds sterling (GBP) and include VAT at the applicable rate. Delivery charges are shown separately at checkout.

We accept payments via the methods listed at checkout, including credit and debit cards, Klarna, Clearpay, and Shopify Payments. Payment is taken at the time of order placement.

If a pricing error is identified on the website before dispatch, we will contact you to either confirm the order at the correct price or cancel and refund in full.

Delivery

Please see our Shipping Policy for full details on dispatch times, couriers, delivery timeframes, signature requirements, proof of delivery, and your responsibilities at the doorstep.

Cancellations, Returns, and Refunds

Please see our Returns Policy and Refund Policy for the four scenarios under which you may end a purchase, the applicable fees, the inspection process, and the timing and method of refunds.

Warranty

All Kubbi products are covered by our manufacturer warranty. Please see our Warranty Policy for the full coverage by product category, exclusions, and the warranty claim process.

Product Use — Important Safety and Legal Information

Kubbi electric bikes, scooters, and quads are designed for off-road, private land use under adult supervision. By purchasing a Kubbi product, you confirm you understand and accept the following points. They are not optional and they form part of your contract with us.

Use on Public Roads Is Illegal in the UK

Kubbi products are not type-approved for use on public roads, pavements, cycle paths, bridleways, parks, or any public space where motor vehicles are restricted under the Road Traffic Act 1988 and related legislation.

Using a Kubbi product on the public highway is a criminal offence in the UK and may result in:

  • Fines and penalties imposed on the rider or supervising adult
  • Seizure or confiscation of the product by the police
  • Endorsement on the supervising adult's driving licence
  • Criminal prosecution under road traffic law

By purchasing and using a Kubbi product, you accept full responsibility for using it in a lawful manner. Kubbi has no liability whatsoever for any fines, penalties, prosecutions, licence endorsements, product confiscation, insurance disputes, or other consequences arising from use of our products on public roads or in any other unlawful manner.

Age Range, Rider Weight, and Supervision

Each Kubbi product is designed for a specific age range and maximum rider weight, which are clearly stated on the product page and in the user manual. You must ensure:

  • The rider falls within the stated age range
  • The rider is within the maximum rider weight
  • Any rider under 14 is under direct adult supervision at all times
  • The product is not used by anyone outside its intended age range, weight range, or skill level

Safety Equipment

Riders must wear appropriate safety equipment at all times when using a Kubbi product. As a minimum, this means a properly fitted helmet. We strongly recommend additional protective equipment including gloves, knee pads, elbow pads, and appropriate footwear.

Kubbi has no liability for injuries arising from a failure to wear appropriate safety equipment.

Modifications

You must not modify a Kubbi product in any way that affects its safety, performance, or legal compliance. This includes (but is not limited to):

  • Removing, bypassing, or remapping speed limiters
  • Fitting non-Kubbi batteries, motors, or controllers
  • Drilling, cutting, or welding the frame
  • Altering electrical systems or wiring

Any modification of this kind voids your warranty and transfers all liability for the product's continued use — including any accidents, damage, or injury arising — to you.

Accidents and Injury

Riding any powered vehicle carries inherent risk. Subject to your statutory rights as a UK consumer and to the limitations set out below in "Limitation of Liability", Kubbi has no liability for accidents, injuries, property damage, or losses arising from:

  • Use of the product on public roads or other unlawful use
  • Failure to follow the user manual, assembly instructions, or safety guidance
  • Failure to wear appropriate safety equipment
  • Use by a rider outside the stated age range, weight limit, or skill level
  • Riding without appropriate adult supervision where required
  • Reckless riding, stunt riding, or use outside the product's intended purpose
  • Modifications to the product as described above
  • Use of the product for hire, rental, racing, commercial purposes, or training schools (unless under a separate written agreement with us)
  • Riding on terrain or surfaces beyond the product's design

This does not affect your statutory rights where an accident or injury is caused by a defect in the product itself, in which case our Warranty Policy and the Consumer Rights Act 2015 apply.

Limitation of Liability

This section sets out what we are and are not legally responsible for. Some things cannot be excluded under UK law, and nothing in this section attempts to do so.

What We Do Not Exclude or Limit

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Breach of your statutory rights under the Consumer Rights Act 2015
  • Any other liability that cannot be excluded or limited under UK law

What We Are Liable For

Subject to the above, our liability to you in connection with any product or order is limited to direct, foreseeable loss arising from defects in the product itself, and is handled under our Warranty Policy and your statutory rights.

What We Are Not Liable For

To the maximum extent permitted by law, we are not liable for:

  • Loss, injury, or damage arising from use of a Kubbi product on public roads or any other unlawful use
  • Loss, injury, or damage arising from failure to follow the user manual, age range, weight limits, supervision requirements, or safety guidance
  • Loss, injury, or damage arising from modifications made to the product
  • Loss, injury, or damage caused by the actions of a third party
  • Indirect or consequential loss, including loss of profit, loss of opportunity, loss of data, or loss of business
  • Loss caused by events outside our reasonable control (see Force Majeure below)

Liability Cap

Subject to the protections above that cannot be limited by law, our total liability to you arising from or in connection with any product or order is limited to the price you paid for that product.

Your Indemnity to Us

You agree to indemnify and hold Kubbi Imports Ltd harmless against any claims, losses, costs, damages, or expenses (including reasonable legal fees) arising from:

  • Your use of a Kubbi product on public roads or in any other unlawful manner
  • Your breach of these Terms
  • Your negligent or reckless use of the product
  • Modifications made to the product by you or someone acting on your behalf
  • Any third-party claims arising from your use of the product

This clause does not apply to claims caused by our negligence, breach of statutory duty, or any matter we cannot lawfully exclude.

Intellectual Property

All content on kubbi.co.uk — including the Kubbi name, logos, product designs, photographs, videos, written content, and software — is the property of Kubbi Imports Ltd or its licensors, and is protected by UK and international intellectual property law.

You may not copy, reproduce, distribute, modify, or publish any of our content without our prior written consent, except as permitted by law (for example, for personal, non-commercial reference).

Account Security

If you create an account on kubbi.co.uk, you are responsible for keeping your login details confidential and for any activity that takes place under your account. Please notify us immediately at support@kubbi.co.uk if you believe your account has been compromised.

Events Outside Our Control (Force Majeure)

We are not liable for any failure or delay in performing our obligations under these Terms where the failure or delay arises from events outside our reasonable control. This includes (but is not limited to) acts of God, war, terrorism, civil unrest, fire, flood, severe weather, pandemics, courier failures, industrial action, government action, and disruption to internet or telecommunications services.

If such an event occurs, we will contact you as soon as reasonably possible to discuss options, which may include extending delivery timeframes or, where appropriate, cancelling and refunding the order.

Privacy and Data

How we collect, use, and protect your personal information is set out in our Privacy Policy, which forms part of these Terms.

Communications and Notices

Any notice or communication from us to you in connection with these Terms will be sent to the email address you provided at the time of order. You agree that this method of communication is acceptable for all legal notices, including notices regarding product safety recalls, changes to these Terms, and order updates.

Notices from you to us should be sent to support@kubbi.co.uk or by post to our registered address.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, our services, or the law. The "last updated" date at the bottom of this page will show when the Terms were most recently changed.

Your rights in relation to any product you have already purchased are not affected by later changes to these Terms — the version in force at the time of your order applies to that purchase.

Severability

If any part of these Terms is found to be invalid or unenforceable by a court or competent authority, the remainder of the Terms will continue in full force and effect. The invalid or unenforceable part will be modified to the minimum extent necessary to make it valid and enforceable, or removed entirely if that is not possible.

Entire Agreement

These Terms, together with the Returns Policy, Refund Policy, Shipping Policy, Warranty Policy, and Privacy Policy, form the entire agreement between you and Kubbi Imports Ltd in relation to your purchase. They replace any previous discussions, communications, or agreements between us on the same subject matter.

Governing Law and Jurisdiction

These Terms and any dispute or claim arising from them or your purchase are governed by the laws of Northern Ireland.

The courts of Northern Ireland have non-exclusive jurisdiction to hear any dispute. As a consumer, you may also bring proceedings in the courts of the part of the United Kingdom where you live.

Disputes

If you have a complaint or dispute, please contact us first at support@kubbi.co.uk with the subject line "Escalation". We will work with you in good faith to resolve the matter.

If we cannot resolve the issue, you have the right to seek further advice from Citizens Advice (citizensadvice.org.uk) or, where appropriate, bring proceedings in the small claims court. We may also direct you to an approved alternative dispute resolution (ADR) provider where one is available for your case.
